The case is a case that involves a conviction of a sexual assault. The two main people involved in the case are the accused, George Pappajohn and the victim, Constance (not the victim’s real name). Pappajohn wanted to sell his house and so he met up with a female real-estate agent at a restaurant, who happened to be Constance. They were very friendly with each other and seemed to have some level of attraction towards each other. Both Pappajohn and Constance had taken shots of drinks, then went to Pappajohn’s house together. Pappajohn’s house is where sexual intercourse took place and also the alleged sexual assault. According to Pappajohn, as soon as they got to his house, he and Constance started to kiss each other on the neck and then walked together to his bedroom. Then he would have sex with her and then tie her up, but as soon as she starts to freak out and instantly starts crying, he stops and goes out to have a cigarette and Constance runs away completely naked, with a bow tie around her neck. According to Constance, she was sexually assaulted. She told him that she was able to get pregnant if they were to have sex and so he did it orally and then had intercourse with her. He then held her hands behind her back, tied them and then had intercourse with her. After that, he would make her gag while having sexual intercourse with her using a bow tie. She would then emotionally go out of control and cry and scream for Pappajohn to stop. He then leaves to have a cigarette and Constance runs away completely naked with a bow tie around her and her hands tied together. When Pappajohn first attempted to have sex with Constance orally, she didn’t do anything physically to stop him or even attempt to stop him. Constance also showed some attraction to Pappajohn by letting him kiss her. Although Constance showed some sort of attraction, this does not mean Pappajohn should assume he has received consent.
